These terms state the conditions for using this website, operated by PKCO, LLC d/b/a Caliber Integrations ("Caliber," "we," "us"). If you do not accept them, do not use the site.
No client relationship
A site visit, inquiry, application, call, proposal, or scheduled meeting does not create a client relationship or require either party to buy or provide services. Paid work is governed only by a separate written Client Services Agreement and statement of work signed by Caliber and the client. Those signed documents control the paid engagement.
Permitted use
You may use the site for lawful business inquiries. You may not:
- Submit false, misleading, unlawful, or unauthorized information.
- Flood, scrape, probe, disrupt, or bypass controls on the site.
- Attempt unauthorized access to the site or related systems.
- Use site content in a way that infringes another person's rights.
Your submissions
You confirm that you have authority to submit the information you send and permit Caliber to use it to review and respond to your inquiry, manage scheduling, secure the site, and otherwise act as described in the privacy policy. Do not submit passwords, payment-card data, government ID numbers, protected health information, children's information, or other sensitive or regulated data through the application form.
Information, not professional advice
Site content and pre-engagement discussions are general business information, not legal, tax, accounting, medical, financial, employment, insurance, or other regulated professional advice. Verify material information with an appropriately qualified professional before acting. Caliber does not promise a particular result, revenue, savings, or business outcome from using the site or attending a call.
Caliber content and marks
Caliber and its licensors retain their rights in the site, original site content, software, and marks. You may view the site for your own lawful business evaluation, but may not republish, sell, or commercially exploit protected content without permission. Third-party names and marks belong to their respective owners; their appearance does not imply endorsement.
Third-party services and links
The site may link to a third-party service, including Cal.com for scheduling. That service applies its own terms and privacy practices. Caliber does not control or promise the availability, security, or accuracy of a third-party service.
Site availability
We may change, suspend, or discontinue site features. To the extent permitted by law, the site is provided "as is" and "as available." We do not promise uninterrupted, error-free, or completely secure operation. Nothing in these terms excludes a right or remedy that applicable law does not allow us to exclude.
Limitation of liability
Please read this section carefully. It limits what you can recover from us.
You use this site at your own risk. To the fullest extent permitted by law, PKCO, LLC d/b/a Caliber Integrations and its owners, personnel, and contractors are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, savings, goodwill, business opportunity, or data, arising out of or relating to this site or its content — including where those damages are caused by our own negligence, and even if we have been advised that they were possible.
Our total liability for all claims relating to this site, under any legal theory, will not exceed one hundred US dollars ($100). This limit reflects that the site and its content are provided free of charge and for general information, and it is part of the basis on which we make them available.
Nothing in this section limits liability for fraud, for willful or wanton misconduct, or for anything else applicable law does not permit us to limit. If part of this section is unenforceable, the rest still applies.
These limits apply to your use of the site. A paid engagement is governed by a signed Client Services Agreement, which carries its own separate liability terms.
Indemnity
You will hold Caliber harmless from third-party claims, and reasonable costs of defending them, arising out of your misuse of the site, your violation of these terms, or information you submit that you did not have the right to share. This does not apply to the extent the claim results from our own fraud or willful misconduct.
Governing law and venue
These terms are governed by the laws of the State of Indiana, without regard to conflict-of-law rules. Disputes arising from use of this site will be brought in the state or federal courts located in Indiana, and you consent to their jurisdiction. Caliber is operated by an Indiana limited liability company based in Indiana.
If you are also a client
If you have signed a Client Services Agreement with us, that agreement controls over these terms for everything it covers.
Changes
We may update these website terms by posting a new version and effective date. The version posted when you use the site applies to that use. A change to these website terms does not amend a signed client agreement.
Severability and waiver
If a provision of these terms is unenforceable, it is limited only as far as necessary and the rest stays in effect. Our failure to enforce a provision is not a waiver of it.
